Terms of Service

1. Introduction

Welcome to Gallery Goose. Please read these Terms of Service (“Terms”, “Terms of Service”) carefully before using the Gallery Goose website (“Website”) and secure 360° walkthrough platform (“Service”) operated by Gallery Goose (“us”, “we”, “our”).

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.

2. Accounts

2.1 Account Creation

In order to use certain features of the Service, you must create an account. When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

2.2 Account Management

Gallery Goose accounts can only be created by authorized administrators. You may not attempt to create an account or access the Service without proper authorization. Your account may be assigned specific access permissions to certain walkthroughs, and you may not attempt to access walkthroughs for which you have not been granted permission.

We may, in our sole discretion, refuse to provide or discontinue providing the Service to any user for any reason, at any time, without notice.

3. Content

3.1 Access to Content

Our Service allows you to access secure 360° panoramic walkthroughs of facilities (“Content”). The Content is intended only for authorized users and may contain confidential or proprietary information.

You agree that all Content you access through our Service is for your informational and reference purposes only. You may not download, copy, reproduce, distribute, transmit, broadcast, display, sell, license, or otherwise exploit any Content for any other purposes without the prior written consent of Gallery Goose or the respective Content owner.

3.2 Content Restrictions

You may not capture screenshots, screen recordings, or otherwise reproduce the Content without explicit permission. You may not share your access credentials or provide unauthorized users with access to the Content.

You understand that the Content may contain confidential information about facilities, and disclosure of such information could potentially compromise security. You agree to maintain the confidentiality of all Content accessed through the Service.

4. Prohibited Uses

You agree not to use the Service:

  • In any way that violates any applicable federal, state, local, or international law or regulation
  • To attempt to probe, scan, or test the vulnerability of the Service or any associated system or network, or to breach security or authentication measures
  • To access, search, or attempt to access or search the Service by any means other than through our publicly supported interfaces
  • To attempt to interfere with the proper working of the Service, including by using any device, software, or routine that may interfere with the proper operation of the Service
  • To attempt to reverse engineer, decompile, or disassemble any portion of the Service
  • To collect or harvest any information from the Service, including account names or Content
  • To impersonate or attempt to impersonate Gallery Goose, a Gallery Goose employee, another user, or any other person or entity

5. Intellectual Property

The Service and its original content (excluding Content provided by users), features, and functionality are and will remain the exclusive property of Gallery Goose and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Gallery Goose.

All Content accessible through the Service, including but not limited to 360° walkthroughs, facility layouts, and associated information, is owned by Gallery Goose or its content providers and is protected by copyright, trademark, and other intellectual property laws.

6. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service and contact your administrator to request account deactivation.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

7. Limitation of Liability

In no event shall Gallery Goose, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the Service
  • Any conduct or content of any third party on the Service
  • Any content obtained from the Service
  • Unauthorized access, use, or alteration of your transmissions or content

Whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

8. Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an “AS IS” and “AS AVAILABLE” basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

Gallery Goose, its subsidiaries, affiliates, and licensors do not warrant that:

  • The Service will function uninterrupted, secure, or available at any particular time or location
  • Any errors or defects will be corrected
  • The Service is free of viruses or other harmful components
  • The results of using the Service will meet your requirements

While we strive to provide accurate Content, Gallery Goose does not warrant that the Content accessible through the Service is accurate, complete, reliable, current, or error-free. Any reliance you place on such Content is strictly at your own risk.

9. Indemnification

You agree to defend, indemnify, and hold harmless Gallery Goose and its licensors, service providers, and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms or your use of the Service, including, but not limited to, any use of the Service’s Content other than as expressly authorized in these Terms.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Oregon, United States, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.

12. Service-Specific Terms

12.1 Secure Access

The Service provides secure access to sensitive facility information. You acknowledge that:

  • All access to the Service is monitored and logged
  • Attempts to share access credentials or bypass security measures may result in immediate termination of your account and could result in legal action
  • You will take reasonable precautions to prevent unauthorized viewing of Content while you are accessing the Service

12.2 Content Accuracy

The 360° walkthroughs are intended to provide visual reference of facilities. While we strive for accuracy, you acknowledge that:

  • Walkthroughs may not reflect the current state of facilities if changes have occurred since capture
  • Measurements or dimensions interpreted from walkthroughs should be verified through other means before being used for critical planning or design
  • Certain areas of facilities may be omitted from walkthroughs for security or proprietary reasons
